A federal judge ruled Thursday that a drugmaker that is marketing erectile dysfunction drug Cialis to consumers can sell the drug to physicians without the knowledge of its maker, Eli Lilly & Co., in the U. S. District Court for the Northern District of California.
The ruling, which is being appealed, was filed by the California Court of Appeal, which was reviewing the FDA's decision about the drugs' label changes in March, and the drugmaker's conduct in the drug's marketing.
The case was heard by U. District Judge Charles K. Geer in San Diego.
Under the judge's ruling, Cialis was being promoted for men with erectile dysfunction, which is a condition that may be present when a man is unable to achieve or maintain a firm erection sufficient for sexual intercourse.
"Erection is not a condition that requires sexual arousal," said federal judge in San Diego, who also ruled that Lilly had not demonstrated that the drug was medically necessary.
Cialis is currently sold under the brand name Viagra, which was approved in 1998 for erectile dysfunction. Lilly said that while the drug was approved for use by patients in 1999, the label changes meant that it could not be used by men whose erection was impeding the flow of sexual activity.
"While we have not seen these changes in the label, we do know that some of these side effects are related to Cialis," said Eli Lilly spokeswoman Cindy Eckert. "We do not know that the side effects associated with Cialis are related to this drug."
The FDA has not made a ruling on whether Cialis is medically necessary.
Lilly's marketing, which is to be made up entirely of a product, has been in the news for years. The company is trying to get a new product with the drug Cialis, which was first approved in 2003 and was promoted for use by men who suffer from erectile dysfunction.
The FDA did not comment on the decision, but reports that the drugmaker has been advertising the drug for more than 30 years.
Eckert said Lilly's ads for Cialis are not unusual for the drug's maker, Eli Lilly and Company, in marketing erectile dysfunction drugs to its own consumers.
"We're not aware of a large number of men who would be interested in the availability of erectile dysfunction drugs," said Eli Lilly spokeswoman Mary Jane Smith.
The FDA's ruling also gives Lilly the power to take action against the manufacturer of the drug, which is marketing the drug for use by patients who suffer from erectile dysfunction.
Lilly said in its statement that it "does not have sufficient information about the potential side effects associated with Cialis and does not believe that information should be considered confidential information to which consumers may object."
Lilly also did not respond to an email from the company's general counsel, Paul A. Guglielmi, who asked not to be identified.
